Many people ask that question. The truthful answer is no. There are many cases people can handle on their own. If you only have a few aches and pains after a crash and you fully recover after a few weeks, honestly there’s no need for a lawyer. The insurance company will probably be happy to give you a little money to sign a release. But don’t sign anything until you’re sure you’re okay.

What is a Deposition | Clearwater Personal Injury

Julia McGrath

What is a Deposition?

Hi. I’m Julia McGrath, an attorney here at the Dolman Law Group. Often times I’m asked by clients what is a deposition and what do I need to do? A deposition is your testimony given under oath. You’ll have a defense attorney who’s asking you questions and you’ll be answering those questions in the presence of a court reporter or a stenographer who is taking down the testimony. Your attorney will be there with you to ensure that no inappropriate questions are being asked. A deposition is nothing to be too concerned about, as long as your attorney thoroughly prepares you.

Finding A Brain Injury Attorney | Fort Lauderdale Personal Injury

John Romano

Finding A Brain Injury Attorney

In a Florida brain injury case, in order to begin the litigation process it is essential that you obtain the services of a very competent, qualified, and experienced trial lawyer. You need to seek out and do the proper research and your due diligence in finding a lawyer who is experienced in handling brain injury cases. And by experience I mean not only a lawyer who has litigated and handled them for years, but a lawyer who has taken brain injury cases to verdict in front of judges and juries.

Alternatives To Court | Fort Lauderdale Personal Injury

Eric Romano

Alternatives To Court

Before filing a lawsuit and taking your case to court, your attorney most likely is going to make a reasonable attempt to try to settle your claim first with the insurance company for the at-fault driver or at-fault party. That typically involves putting a demand package or claims package together which includes the crash report, photos, medical records, wage information and any other documents or information supporting your claim. And that’s an effort typically made to avoid litigation. Trying to resolve the case directly with the insurance company without the need to go to court. If that doesn’t work then your attorney will file a lawsuit, your case will then go into litigation will be handled over the courthouse. But you will still have opportunities to try to resolve the case before it gets to trial through such things as mitigation and sometimes arbitration.

Motorcycle Accident Investigation | Fort Lauderdale Personal Injury

Todd Romano

Motorcycle Accident Investigation

The investigation of a motorcycle accident is critical. Oftentimes you will have many witnesses, for example in an intersection collision case, and several years later when you take the depositions or sworn statements of those witness who have all observed the same exact crash, they will have greatly varying versions of what actually happened. So the investigation of a motorcycle accident is critical; you have to preserve evidence at the scene. Where did the motorcycle come to rest? Where did the other vehicles come to rest? Where were witnesses when they observed what happened? Were there skid marks or gouge marks in the roadway?

It’s crucial that you investigate very soon after a motorcycle accident to preserve that evidence that will become critical in later reconstructing the accident to determine who was at fault for the crash.

Contingency Fees | Todd Romano Personal Injury

Todd Romano

Contingency Fees

In Florida, attorneys are permitted to represent you as consumers on a contingent fee basis. Oftentimes, when you’ve been involved in a catastrophic injury case or accident or situation, those cases will take years sometimes to travel through the litigation process. If you’ve suffered a catastrophic injury and you have mounting medical bills and are unable to work, a contingent fee representation system such as the one we have in Florida permits you and your attorneys to match the resources of the insurance industry or the trucking industry to help you along in your catastrophic injury case. All that means is you don’t pay your attorney fees until the end of the case, and only pay them if there’s been a recovery in the case. The attorneys get a percentage of that recovery for attorney fees. It also allows your attorneys to advance the costs of your case, and then only recoup those costs at the end of the case if there’s been a successful recovery on your behalf.
