Suing Driver, Bicycle Accident

If you’re injured while riding your bicycle, can you sue the driver that hit you? Well the answer to that really is it depends. In order to have a valid basis to file a lawsuit or a claim of any kind against the driver that hits you, you have to look at the circumstances surrounding the accident, because in order to hold the other driver responsible, you have to be able to prove that that driver was negligent or careless, meaning that he or she did something wrong or something inappropriate. It usually involves trying to demonstrate that that driver violated the common rules of the road, or committed a traffic infraction that resulted in the accident.

Alternatives To Court

Before filing a lawsuit and taking your case to court, your attorney most likely is going to make a reasonable attempt to try to settle your claim first with the insurance company for the at-fault driver or at-fault party. That typically involves putting a demand package or claims package together which includes the crash report, photos, medical records, wage information and any other documents or information supporting your claim. And that’s an effort typically made to avoid litigation. Trying to resolve the case directly with the insurance company without the need to go to court. If that doesn’t work then your attorney will file a lawsuit, your case will then go into litigation will be handled over the courthouse. But you will still have opportunities to try to resolve the case before it gets to trial through such things as mitigation and sometimes arbitration.

What you should look for is online resources. Look at legal directories. Find out what kind of awards this attorney has won. Look at their reviews. Go online to Google and see if other members of the community have reviewed this law firm. What kind of reviews do they have? Keep in mind there will always be negative reviews on anyone, but what do the majority reviews tell you? Is the lawyer accessible? Are they knowledgeable? Are they competent? Have they tried cases before?

Determining Fault For Auto Accidents

The fault is not always easily determined in an automobile accident case. Sometimes it will be clear-cut such as a rear-end collision, although even a rear-end collision is not always as simply as straight forward as it may seem.
