If you’re hurt on the job, whether it’s Indiana or Kentucky, it doesn’t matter whose fault it was. Some clients will ask, “Well, it was my company’s fault. Can I sue them?” Well, your only recovery against your employer is worker’s compensation. You can’t sue your employer if they were negligent. At the same time, even if you were negligent – if it was your fault for getting hurt – as long as you didn’t violate some company safety rule, then it doesn’t matter whose fault it was. So if you were hurt on the job, as long as you’re doing your job in the course and scope of your employment, you can get your medical bills paid and get your worker’s compensation benefits paid to you.
