Insignificant Defenses Insurance Companies Make
We often hear from insurance companies complain about frivolous lawsuits. But you never hear about frivolous defenses that the insurance companies make. For example, one of my favorite cases was a client who was coming down an entrance ramp to the interstate. The defendant driver was driving down the highway trying to beat a tractor trailer, hit the tractor trailer, spun out of control, and literally spun sideways into my client. My client was coming down the entrance ramp, sees this car out of control, and stops on the entrance ramp because of that, thinking I don’t want to get down on the highway. So this car literally spun sideways and hit my client. The insurance company said they weren’t at fault because if my client had just kept right on going, then they would have missed him.
