Under both Indiana and Kentucky, we have laws what are called comparative fault. Again, each case is unique. So it’s hard to try to say what happens in each individual situation. But often times what will happen is that a jury ultimately would look at what’s called comparative fault. So if someone– if you, the injured person, if a jury thinks that you might be partially at fault, then you can still recover, but the damages could be reduced by whatever percentage allocation is put on you for being at fault.
