Don’t ever talk on your cell phone or text while you’re driving your car. Kentucky and Indiana both– it’s against the law to text while you are driving your car. You are allowed to use your phone, but it’s best to use it with a Bluetooth speaker device so you can use hands free and not be totally distracted. But if you are talking on your cell phone, the insurance company may want to subpoena your cell phone records to try to put some fault on you– what’s called comparative fault, meaning that fault can be a portion between the two drivers. So if you’re hit by a truck for example, and you’re on your cell phone, then they may be able to a portion some of the fault to you to reduce your damages. I’m attorney Karl Truman.
