Lemon Law Substantial Nonconformity
In California, to get your money back from a Lemon Law Case, what you need is something called a substantial nonconformity, and that could be something like the engine stalling. That could be something like the sunroof wouldn’t close. That could be something like the door locks don’t open, and your trapped in the car. It has to be something substantial, and it has to affect someone’s use, value, or safety of the car. Built in the law is a requirement that the manufacturer has to pay attorney’s fees. This allows a consumer, who may not have the money or resources to hire a lawyer, to go ahead and retain to someone like myself in California, and go ahead and pursue something against the manufacturer, and not have to worry about the attorney’s fees. It’s the manufacturer’s responsibility to pay those fees. When I get a case, I do my best to resolve that case as quickly as possible. I want to talk to the consumer, explain to the consumer what their rights are under the California Lemon Law, and get that thing over with and done as quickly as possible so they can move on with their life, because I know it’s really important.
