Oftentimes I have clients come to me after they’ve been injured as the result of an assault outside a bar, a restaurant, or even at an apartment complex. They want to know can they bring a claim for the personal injuries that they’ve suffered. What I do is I explain to them that these types of claims are called negligent security claims here in Florida.

Were Injuries Foreseeable?

Next, we talk about what do we need to prove as the plaintiff in order to succeed on that type of claim. We need to show that the business or the landlord should have known that your injuries were foreseeable. In order to do that, we look to see whether the police were called to the scene before, how many other similar crimes or occurrences occurred on that premise, and we use that information to show what the business failed to do was have security in place to protect you as the patron, as the tenant, or as a visitor on that premise.
