Alimony Payments
Everyone always wants to know how much alimony they’re entitled to, or how much they’ll have to pay. It really would make things easy if there was a simple answer, wouldn’t it? The real answer is that it depends on the circumstances. In New Jersey we have a statutes with the governments alimony. The statutes sets forth the variety of factors the court should consider when determining if alimony is appropriate, what kind of alimony is appropriate and how much alimony should be ordered. As with all statutes that have factors if two people look at your life they would probably come up with two very different opinions about alimony.
Determining Amount
When determining the amount of alimony we’re suppose to consider the actual need of the dependent spouse, the ability of the supporting spouse to pay and the standard of living established during the marriage. Most attorney’s use a mathematical shortcut to get a starting number to get the alimony discussion started. But our law specifically prohibits calculating alimony based upon a formula. The amount of alimony is one of the most litigated issues in a divorce. Since there is no formula sanctioned by the law people are left to find a number that they both can live with. You need an experienced attorney who can navigate alimony and get the best possible result.
