Receiving a Grand Jury Subpoena in Texas

Hello, my name is Dan Cogdell. I’m a lawyer here in the state of Texas. If you’ve just been on the receiving end of a grand jury subpoena, here are a few things that you need to know.

Thing number one, it’s a very significant event.  It’s not something that you should ignore or not respond to.

The second thing that you need to know is, those dates are usually inflexible. You can’t call the morning of your grand jury appearance and reset your grand jury appearance. It’s not a traffic ticket. It’s a very serious matter.  

The third thing that you need to know, is if you don’t show up, you are likely to be arrested. A marshall or a sheriff’s office, or a police officer, can come and get you if you’ve been properly served and you don’t appear.

The last and maybe the most important thing that you need to know, is that if you’ve received a grand jury subpoena, you need to hire a lawyer to work with you and assist you in complying with that grand jury subpoena.  They may be looking at you as a witness, they may be looking at you as a subject, which is a sort of a category between being a witness and a suspect, or they may be looking at you as a suspect. And generally speaking there is no way you can just look at a grand jury subpoena and figure out if they’re really looking at you to prosecute you, or if they’re looking at you simply as a witness.
