FBI Agent Questioning Process
The phone rings or the door knocks and you learn that the person at the other end of the phone or on the other side of the door is an FBI Agent – what do you do? Hello, my name is Dan Cogdell. I’m a criminal defense lawyer here in the state of Texas. “Knock, knock. Who’s there? The FBI,” is never a joke. It’s never funny. It’s a serious situation. So what do you do?
Step One
The first thing that you do is be polite to the agents. Don’t be aggressive, don’t be hostile, don’t be threatening.
Step Two
The second thing to do is to tell them you want to confer with your lawyer before making any statement. Don’t try to talk your way out of something. Don’t try to explain something. Don’t try to minimize something. Assert your right to counsel, it’s given to you by the constitution. Tell the FBI you want to confer with a lawyer before you make a statement.
Step Three
And the third, and maybe the most important thing, that you do is find the right lawyer. Find a lawyer that’s experienced in handling matters prosecuted by the FBI and the Federal Government. Find a lawyer who knows what to do, who knows how to help you. If you have questions about what to do when the FBI comes knocking, call us. It’s what we do.
